ANNUAL MEETING NOTICE

Proposed Meeting Agenda:

A. Welcome and State of the HOA Address – Benjamin Donner, HOA President
B. HOA Financial Reports – Jason Sucher
C. Election of ROSE CREEK CROSSING HOA Management Committee by private ballot
1. The 3 homeowners who receive the most votes will be on the ROSE CREEK CROSSING HOA Management Committee.
2. The term of the 3 positions will be two years each.
3. Please see the excerpts from the by-laws on the reverse of this document. **

2. Pool Rules discussion – Guests Etc.

• **We are in need of 3 Volunteers willing to dedicate 2-4 hours per month to serve on the Management Committee. If you are interested in serving on the HOA Management Committee, please notify Jason Sucher at 866-500-7368 or please send an e-mail to rose.creek.crossing@gmail.com stating your intentions at least seven days in advance of the meeting. WE ESPECIALLY NEED VOLUNTEERS FROM THE TOWN HOMES.


Excerpts from By-Laws

• Paragraph 2.2 of the By-Laws says that at the meeting of the HOA members following termination of Declarant control, “the Owners shall elect a Management Committee of five (5) members”.
• Para 2.2 also says nominations for positions on the Management Committee may be made by petition filed with the Secretary of the Association at least seven days prior to the annual meeting of the HOA.
*** If a person is interested in serving on the Rose Creek HOA board, that person should please send an e-mail to rose.creek.crossing@gmail.com stating this seven days in advance of the meeting.
• Paragraph 2.3 says voting shall be by written ballot.
• The election at the meeting shall be for general positions on the HOA board. Paragraph 2.9 says the Management Committee itself shall elect the officers at the first meeting of the Committee. Para 4.1 says the officers shall be President, Secretary, and Treasurer (though the offices of Secretary and Treasurer can be combined) and that the Committee may appoint Vice Presidents and other assistants officers as they may deem necessary.
• Paragraph 15.1 states that At least two (2) of the Board members shall be Owners of a town home.
• Please refer to the by-laws for more information about board service and the elections.

Important Notice for Rose Creek Homeowners

****IMPORTANT NOTICE FOR ROSE CREEK HOMEOWNERS****

We have two important items to bring to your attention – please read the following:

Due to defects in the original key operating system, and to adequately protect our community clubhouse and pool, the Rose Creek HOA Board of Directors find it necessary to update the clubhouse access security system. Over the years, many clubhouse access cards have stopped working, have been lost, borrowed or even stolen. This leaves our most expensive amenity open to potential abuse and damage.

For this reason, effective immediately, ALL clubhouse and pool access cards will be deactivated. It will be necessary for every owner to have their clubhouse security key cards scanned and reactivated to be able to access the pool and clubhouse. This will require each owner to bring all keys in their possession to the clubhouse to have them scanned. The whole process will take less than 5 minutes at the clubhouse.

In an effort to minimize the inconvenience, we will have a representative at the clubhouse at the times listed below to allow for varied work schedules etc. Please choose a time that will be most convenient for you. If you are not able to personally make one of these times, you may send your keys with a friend or neighbor. If you do not get your card activated at one of these times, there will be a $25.00 charge to activate it later.

Saturday March 26 – 9:00 am to 12:00 noon
Monday March 28 – 7:00 pm to 9:00 pm
Friday April 01 – 6:00 pm to 8:00 pm

In accordance with Utah State Law, the Rose Creek HOA recently commissioned a professional reserve study to help create a maintenance and savings plan for the next 30 years. Based on the findings of this Reserve Study, the HOA board has approved a modest fee increase (our first since the community was developed) for all of the homes in Rose Creek to help accelerate the HOA savings, while maintaining adequate funds for the day to day operations. The reserve study can be downloaded and reviewed at www.rosecreekcrossing.com.

Effective May 1, 2011 the monthly fees for the townhomes will increase by $10 per month, and the single family homes will increase $1.50. New payment coupons will be sent to each owner not already signed up for monthly electronic funds withdrawal through Advantage Management. Those that are subscribed to electronic funds withdrawal through Advantage Management, will automatically have the new fees drafted beginning in May unless Advantage Management is specifically instructed not to draft the funds.

New Website Look Coming Soon

I hope everyone is having a great 2011 so far!

We are very aware that this website needs some serious help. We have had requests for online calendars, neighborhood updates, etc. We are presently working on finding a solution - so please be on the look out! If any of you have any expertise in this area and can give some pointers, assistance, etc... we would greatly appreciate it!
